The petitioner has alleged that the Child Development Project Officer, Pandua, ICDS Project, did not consider the petitioner's request for transfer to Anganwari Centre No.81. The learned advocate for the State respondents submits that on the willingness expressed by the petitioner, an order was passed by the Child Development Project Officer, Pandua, ICDS Project dated December 6, 2019 to transfer the petitioner from Anganwari Centre No.81 to No.84. At the relevant point of time, the petitioner was working as Anganwari Karmee at Centre No.81. Now, the petitioner wants to go back to the erstwhile place of posting. It appears from the records that the petitioner had been transferred from one particular centre to another centre within the same block on her own request. The petitioner moved out of Centre No.81 and joined Centre No.84. Now the prayer for being reverted back to the Centre No.81 cannot be allowed as a matter of right.

However, the petitioner claims that she is old and has to travel a considerable distance. As such, the petitioner's representation through her learned advocate, dated August 13, 2021 be disposed of by the Child Development Project Officer, Pandua, ICDS Project, in accordance with law and upon taking into consideration the ground reality, logistics, feasibility and vacancy position. An intimation shall be given to the petitioner in this regard, within two months from the date of receipt of a copy of this order. The petitioner is directed to serve a copy of this writ petition along with a server copy of this order upon the Child Development Project Officer, Pandua, ICDS Project. Accordingly, the writ petition is disposed of. However, there will be no order as to costs.

All the parties are directed to act on the basis of the server copy of this order.
