Ms. Sukanya Bhattacharya, learned A.P.P.-in-charge is present in Court and she is requested to assist this Court in the instant matter to which she has agreed. The appointment of Ms. Bhattacharya with Mr. Prasum Kumar Datta be regularized. It is pointed out by the learned P.P. -in-charge that the accused persons, in all 15 in number were granted bail by the trial court on 14th June, 2017 in a case under Sections 498A/34 of the Indian Penal Code read with Sections 3 and 4 of the Dowry Prohibition Act. The said order of bail is sought to be cancelled at the instance of the de facto complainant/petitioner. The accused persons/opposite parties are enjoying bail for last five years. It may so happen that the trial of this case is concluded.
Considering the nature of the case, it is not at all necessary to cancel the bail of the accused and their custodial detention is not necessary.
In view of such submission, the instant application is dismissed.
