24.6.2026 Court No.28 Item No.38 AB Allowed CRM (A) 1712 of 2026 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023/Section 438 of the Cr.P.C in connection with Englishbazar P.S. Case No. 0671 of 2026 dated 30.4.2026 under Sections 85/82(1)/351(2) of the Bharatiya Nyaya Sanhita.

And In the matter of: Rima Khatun & Ors.

....Petitioners.

Mr. Kazi M. Rahman ...for the petitioners.

Ms. Priti Kar Bagchi ....for the State Leave is granted to correct the cause title.

Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the married sister-in-law, the husband and the second wife of the petitioner. The marriage between the petitioner and the de facto complainant took place eight years ago. Only after the second marriage of the petitioner no. 2, troubles started. The petitioners have been falsely implicated in this case. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. She submits that the petitioner no. 2 got married to the petitioner no. 3 without the consent of the first wife. The petitioners did not respond to the notices issued.

Considering the above and the other materials available in the case diary, I am inclined to grant anticipatory bail to the petitioners.

In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioners shall not threaten or intimidate witnesses and shall co-operate with the investigation. The petitioner no. 2 shall meet the I.O. once a week.

The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
