In Re : An application under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973;

In the matter of : Sri Alok Adhikary. ...petitioner. The subject matter of grievance of the petitioner/husband relates to the order dated 6.12.2012 passed by the learned Chief Judicial Magistrate, Nadia thereby directing the husband/petitioner to pay a sum of Rs.2,000/- per month to the wife/opposite party no.2 as maintenance from the date of filing of the application under Section 125 of the Code of Criminal Procedure. Having regard to the quantum so awarded and the minimum expenditure required for an individual to survive, I am of the view that no interference is called for.

Accordingly, CRR 1239 of 2013 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
