The petitioner happens to be the father of a minor child Samhita Ghosh. The child participated for admission in Class - VI in a school run by Visva Bharati. There are total ten unreserved seats in the open category. The daughter of the petitioner secured the tenth position in the merit panel.

The allegation is that she has not been admitted as all the vacancies have been filled up. Prayer has been made for admitting her in the said institution as she secured the tenth position.

The learned advocate representing Visva Bharati submits, upon instruction, that all the ten vacancies had been filled up in view of the fact that one candidate from the reserved category who scored equal marks but is older in

age had to be upgraded and admitted in the unreserved category seat and accordingly the petitioner's daughter could not be accommodated. However, as a special measure one extra seat shall be made available for the daughter of the petitioner as a special chance.

In view of such fair submission made on behalf of Visva Bharati in Court, the instant writ petition stands disposed of by directing the respondent No. 6 being the Adhyaksha, Siksha Satra to take necessary steps for admission of the daughter of the petitioner in Class - VI of the said school at the earliest.

The writ petition stands disposed of.
