Habibur Rahman Mr. Saba Parween ... for the petitioner Mr. Subhabrata Datta Mr. Debashis Sarkar ... for the State The petitioner is aggrieved that the Baguiati Police Station has not enquired into a complaint lodged by him in the year 2015 against one Ganesh Das Chhangani. The said complaint concerned a transaction involving failure to refund a sum of Rs.4 lacs lent and advanced. The petitioner's first complaint was in the year 2015 and the police had only started pursuing the matter in the year 2019, through the Commissioner of Police. The Inspector-in-Charge, Baguiati Police Station has submitted instructions to Government Pleader that the petitioner did not want any further investigation or registration of FIR, and hence only a GD entry was made. Report was sent to the office of the Commissioner after the petitioner's complaint was endorsed to the Baguiati Police Station.

This court is of the view that the dispute is purely civil in nature and has very little criminality. In that view of the matter, the petitioner may pursue civil remedies against the private respondent, if maintainable in law. With the aforesaid observations the writ petition is disposed of.
