The writ petitioner has applied before the District Magistrate and Collector, Uttar Dinajpur on 30th June, 2021 for change of site of country liquor retail shop from Dakshin Kundalpokher to any other place. He is aggrieved that the said request has not been considered till date. It transpires that the original licence dated 16.01.2006 has expired on 31.03.2006. There is no question of applying any of the Rules either 2003 Rules or 2009 Rules for the purpose of considering the change of site of the petitioner's shop since the petitioner did not have valid licence as on 30th June, 2021.

It appears that the said fact has been suppressed in earlier proceedings before this Court. Hence, no relief can be granted to the petitioner. Accordingly, the writ petition is dismissed.

There will be no order as to costs.
