Affidavit-of-service filed on behalf of the petitioner is taken on record.

In spite of service of notice private respondents are not represented.

However, State respondents are represented by learned advocates.

It is submitted by the learned advocate representing the petitioner that petitioner's right over the property in question is at stake due to interference by the private respondents prompting the petitioner to approach this Court with the present writ petition seeking direction upon the concerned police authority to protect his right over the property in question. 5.
On behalf of the State respondents a communication dated 19th June, 2026 of Inspector-in-Charge, Amdanga Police Station, Barasat PD, North 24 Parganas is filed and same is taken on record. Copy of the said communication dated 19th June, 2026 is made over to the learned advocate representing the petitioner.

It is disclosed in the said communication dated 19th June, 2026 that there is a dispute over the property in question between the petitioner and private respondents. It further appears from the communication that one suit was instituted being Title Suit No.606 of 2019.

Considering the issue involved in this writ petition, it appears that the same is civil in nature requiring the petitioner to approach the civil court in pursuit of remedy.

Police authority is not the appropriate authority to decide inter se right of the parties over the land in question.

Concerned police authorities are directed to maintain peace and tranquility at the locale and to see that no untoward incident takes place.
10. However, this order shall not preclude the petitioner to approach civil court in pursuit of remedy.
11. Writ petition stands disposed of.
12. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings. (SAUGATA BHATTACHARYYA, J.)
