Vaisya Mr. Ranjan Saha ... for the State Mr. Saikat Banerjee Mr. Ratul Biswas Mr. Kaushik Chowdhury ... for the WBBPE The petitioner's case is that as she failed to produce the OBC-B Category Certificate, she was considered in the TET examination for 2022 as a General Category Candidate. She also applied for a General Category Candidate. Now she wants to take the advantage of reservation under OBC-B.

It appears from the document that though her father did not have any OBC-B certificate, her father's sister and her own elder brother had OBC-B certificates. Therefore, there is no doubt that the petitioner is also an OBC-B category candidate. It appears from documents (Annexure P-4) that the certificate was made ready on 15.09.2022 which was handed over to her on 29.11.2022.

Therefore, I direct the Deputy Secretary of the West Bengal Board of Primary Education to look into the matter so that the petitioner can be considered as an OBC-B category candidate and she should be declared as a pass candidate in TET 2022 since her score is 84 which is sufficient for the reserved category candidates.

The list of dates, as was directed by this court, has been filed by the petitioner. A supplementary affidavit showing that the petitioner's father's sister and the petitioner's own elder brother got OBC-B category certificates from the appropriate authority has been filed in court today. Those are kept with the record. With the above observation and direction this writ application is disposed of.
