C.R.M. (M) 664 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Liluah Police Station Case No. 121 of 2025 dated 22.02,2025 under Sections 118(2)/109/3(5) of the Bharatiya Nyaya Sanhita read with Section 25(1-b)(a)/27 of the Arms Act.

Mr. Arindam Sen Sufi Kamal ... For the State Learned counsel for the petitioner submits that the only role attributed to the petitioner is that he being a resident of the locality, identified the victim to the assailants. The petitioner says that he was only asked to identify the victim and was not aware of the motive of the assailants. There is no material suggesting prior meeting of minds or conspiracy. Charge sheet has been submitted. Allegations under the Arms Act have not found place in the charge sheet.

Learned counsel for the State opposes the prayer. The submission made by the petitioner has been taken into consideration by this Court in the earlier order dated 21st April, 2025 whereby prayer for bail of the petitioner was turned down. Besides charge sheet having been submitted thereafter there is no change in circumstances of the case which calls for a favourable order at this stage.

Accordingly, the prayer for bail is rejected at this stage.

The application for bail is disposed of.
