AND In the matter of:- Prabir Ghosh ... petitioner Mr. Bidyut Kumar Roy, Mr. Ashok Das ...for the State Report submitted by learned advocate for the State prepared by Officer-in-Charge, Noapara Police Station be kept with record. The present application for cancellation of bail was preferred in the year 2018 against the order dated 26.04.2018, passed by the learned Additional Chief Judicial Magistrate, Barrackpore, in connection with Noapara Police Station Case No.110 of 2018. Report so submitted by the Officer-in-Charge, Noapara Police Station do not reflect that there has been any misuse of liberty or any serious misconduct on behalf of the petitioners. Having regard to the same, I am of the view, that after three years, there is no reason to interfere with the order of bail being granted by the learned A.C.J.M., Barrackpore.

However, the learned A.C.J.M., Barrackpore will be at liberty to impose condition, if he is of the view that the accused/opposite parties are creating any hindrance in the progress of the case. Accordingly, C.R.M.4751 of 2018 is disposed of with the aforesaid directions.
