Learned advocate appearing for the State submits that, the evidence of the prosecution is continuing. The witness of the prosecution was examined on February 9, 2022 and that today is another date fixed for the purpose of recording the evidence of the prosecution.

Considering the fact that the evidence of the prosecution is likely to be over very soon and considering the fact that the prosecution is proceeding with earnest with the trial and considering the fact that the trial is at the fag end and considering the fact that there is hardly any change in circumstances subsequent to the earlier order of rejection it would be inadvisable to enlarge the petitioner on bail at this

crucial stage of the trial. We are unable to grant bail to the petitioner.

Accordingly, prayer for bail of the petitioner is rejected and the application being CRM 5793 of 2021 is dismissed. (Debangsu Basak, J.) (Bibhas Ranjan De, J.)
