Petitioner's application under Section 173(8) of the Code of Criminal Procedure was rejected. Against that, this revisional application was preferred. I do not find that the reasons so assigned by the learned Magistrate calls for any interference in this application as the investigating authorities have exercised their due diligence in arriving at a conclusion. However, if the petitioner intends to prefer an application under Section 200 of the Code of Criminal Procedure, the learned Magistrate will consider the said petition of complaint in its proper perspective and exercise his discretion regarding further progress of the said complaint case.

With the aforesaid observations, the revisional application being CRR 1965 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
