No one appears on behalf of the State, despite intimation.

Learned counsel appearing on behalf of the petitioners submits that despite getting permission to construct a boundary wall over their recorded land, the petitioners are being obstructed by the private respondents.

Learned counsel appearing on behalf of the private respondents submits that they had challenged the wrong recording in the record of rights. The Appellate Authority passed an order in favour of the private respondents and the matter was remanded back to the BL&LRO to hear the matter afresh. Let the BL&LRO dispose of the matter at the earliest, preferably within a period of four weeks from the date of communication of this order after hearing the concerned parties.

However, the respondent police authorities shall keep a sharp vigil at the locale and ensure that no breach of peace takes place.

With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
