AB C. O. 1765 of 2024 Sri Ashim Chandra Trigunait Vs Sri Amitava Trigunait & Others Mr. Chittapriya Ghosh .....for the Petitioner. In this application under Article 227 of the Constitution of India, a direction has been sought for upon the learned Civil Judge (Sr. Division), Purulia to dispose of Title Suit No.69 of 1931 expeditiously. Title Suit No.69 of 1931 is a suit for partition. The said suit was decreed on compromise in preliminary form on 04.03.1932. Thereafter a Partition Commissioner was appointed to effect partition. Mr.

Ghosh submitted that the Partition Commissioner has already submitted his report. However, no decision with regard to such report has been taken by the learned Trial Judge.

It appears from the order sheet dated 28.03.2024 that the application under Order 6 Rule 17 of the Code of Civil Procedure was rejected.

Considering the fact that the suit is pending from the year 1931, the Civil Judge (Sr. Division), Purulia is directed to make an endeavour to dispose of T.S. No.69 of 1931 as expeditiously as possible but preferably within a period of six months from the next

date fixed without granting any unnecessary adjournment to either of the parties.
