The petitioner's husband was accused of kidnapping and murdering a minor for which FIR was registered against him under Sections 363/302/201/120B of the Indian Penal Code. He was arrested and subsequently granted bail. Charge sheet has been submitted therein. In connection with the said incident a group of more than 1000 people attacked and ransacked the house of the petitioner and the petitioner was constrained to flee away therefrom. She is still unable to return to her house even after passage of about 2 years. The petitioner seeks police protection to return to her house and lead a safe and secure life.
Learned counsel for the State submits that several FIRs have been lodged with regard to the attack on the petitoiner and her house and charge sheets have been submitted.
The petitioner has submitted a representation before the Superintendent of Police, Paschim Medinipur on 17th
April, 2025 requesting police assistance and security to return to her house and stay therein.
Since the petitioner is unable to return to her house due to threat on her life and liberty, the police authority is directed to provide adequate police assistance to the petitioner so that she is able to return to her house safely. The police authority shall also provide adequate security to the petitioner to protect her life and liberty in the said house as well as the village. The petitioner shall intimate the date and time of her proposed return to her house before the police authority in order to enable the authority to take necessary steps in this regard.
With the above observations and directions, the writ petition is disposed of.
There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
