The petitioner approached this Court for defreezing the account wherein deposits were from the GPF account of the petitioner. The CID, West Bengal has submitted a report dated 05.05.2025 which reflects as follows :- "Under the above circumstances, it is respectfully submitted that the Investigation agency does not have any objection to release Rs.

39,41,489/- (Rupees thirty nine lakhs forty one thousand four hundred eighty nine) only which was sanctioned and paid as GPF accumulated amount from Union Bank of India A/C No.

460902010093092 of accused Sabyasachi Saha

(51) S/O Lt. G.C.Saha of AD-211 Sushil Jyoti Avenue, Rabindrapally, New Shiv Temple, POPrafulla Kanan, PS-Baguihati, Kol-101. The rest of the amount left in the account may kindly remain as debit freezed till completion of trial."

In view of the stand taken by the investigating agency that they have no objection to release Rs.39,41,489/- which is available at Union

Bank of India A/c. No. 460902010093092, I am of the view that the said amount be released in favour of the petitioner forthwith.

Since there is an objection in relation to rest of the amount, petitioner would be at liberty to canvass the issue before the learned Special Court so far as the interest which accrued or any other amount which is being retained in the aforesaid account maintained with Union Bank of India.

Petitioner would inform the learned Special Court.

The learned Special Court would immediately comply with the part of the order passing necessary directions upon the Union Bank of India.

The learned Special Court is directed to act on the server copy of this order and dispose of the application of the petitioner relating to implementation of the aforesaid order within a period of 24 hours from the date of filing of the application.

Report so submitted on behalf of the State be kept with the record.

With the aforesaid observations, the writ petition being WPA 13781 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
