Mr. Chittapriya Ghosh, Mr. Kuntal Ray, Ms. Priyanka Saha, Ms. Komal Singh ....for the petitioner Mr. Aniruddha Tewari ...for the respondent nos. 6 and 7 The Ghola Police Station, North 24 Parganas has filed a report. The same is taken on record. It appears to this Court that the observations by the Investigating Officer as communicated by the Officer-in-Charge, Ghola Police Station that the petitioner was not available for the investigation cannot be completely brushed aside.

Mr. Chittapriya Ghosh, learned counsel for the petitioner, however, submits that neither his client nor the Advocate on record have ever received any notice from the Ghola Police Station.

The respondent nos. 6 and 7, who are the coaccused, are represented today. They are on bail. The petitioner shall assist the Investigating Officer in identifying the whereabouts of the main accused. The petitioner shall meet the I/O at 2 p.m. at Ghola Police Station on January 21, 2023.

Investigation may be reopened and completed, preferably within a period of 45 days from date. With the aforesaid observations, the instant writ petition shall stand disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
