We have heard the learned Counsel for the parties.

It appears that the petitioner is required to clear the backlog within August, 2023 and as a special case he could be given two chances in total to clear his backlog within the aforesaid time. This was the proposal of the University which was accepted by the learned Single Judge.

The learned Counsel for the appellant submits that the University should make an arrangement so that he could complete the course by December, 2024 by arranging special classes so that he could clear his backlog.

We find from the impugned order that the petitioner has been asked to attend the classes so that he can clear his backlog and finish the course in conformity with the applicable UGC Regulations,

which mandates that before sitting in a semester examination, a student must attend 16 to 18 weeks of classes. It is an admitted fact that in spite of giving him opportunity to clear the backlog of papers in the 2nd and 3rd semester which are six papers, he could not clear the 3rd and 5th semester. We find that the stand taken by the University is reasonable. The University is following its own regulations. The University cannot be compelled to change his regulations to suit students. In fact, enough opportunity was given to the students to clear the backlog. However, in the event the petitioner is able to clear the backlog in August, 2023, the University may consider the prayer of the petitioner to finish his law degree by December, 2024 if required and feasible by taking special classes.

With the aforesaid observations, the appeal and the application stand disposed of.

However, there shall be no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
