It is submitted by Mr. Banerjee placing a copy of the judgment passed in Sunita Palita & ors. vs. M/s. Panchami Store Quarry in connection with SLP (Crl.) No.10396 of 2019, delivered on 1st August, 2022 that a proceeding under Section 138 of the N.I. Act shall not lie against independent director like that of the present petitioners.

In view of the judgment, the instant criminal revision be dismissed as infructuous.

As a consequence the application for extension of interim order is also dismissed.
