Mr. Shovan Ghosh Ms. Chirantani Ghosh ... ... for the petitioner Mr. Joydeep Roy Mrs. Sujata Das ... ... for the State The petitioner is aggrieved by the fact that in spite of the case being initiated in the year 2014 and charge sheet being submitted in the year 2017, till date charges have not been framed. The petitioner is directed to hand over a copy of the revisional application upon Mrs. Sujata Das, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularised by the concerned authorities.

Having regard to the anxiety expressed by the petitioner, I am of the view that the same is justified.

Learned trial court would take immediate steps for consideration of charges by compelling the accused persons to appear before the court on the date so fixed. If they fail, the same may be complied within a reasonable period of time, positively within a month from the next date fixed by the learned trial court.

If the learned trial court is satisfied that the charges are triable, in that case the learned trial court would fix one date in every 45 days so that the trial of the case be taken to its logical conclusion within a reasonable period of time.

No unnecessary adjournment be granted to either of the parties. Learned Public Prosecutor conducting the trial would take steps to produce the materials, exhibits and the documents on the dates fixed for examination of the witnesses. All the stakeholders would take effort to conclude the trial at the earliest.

With the aforesaid observations, CRR 1954 of 2023 is disposed of.

Pending connected application, if any, is consequently disposed of.
