I have perused the statement under Section 164 of the Code of Criminal Procedure of the victim lady. I have considered the complicity of the present petitioner. Records of the revisional application reflects that warrant, proclamation and attachment is pending against the present petitioner viz. Krishnendu Shit @ Sk. Jahangir. Learned advocate appearing for the petitioner intends to surrender before the jurisdictional court.

Accordingly, the proclamation and attachment so issued by the learned trial court is stayed till 23.06.2023. However, the issuance of warrant of arrest is not interfered with.

If the petitioner surrenders before the learned Additional Chief Judicial Magistrate at Haldia within the

aforesaid date, his application for bail, if any, would be considered in accordance with law.

With the aforesaid observations, the revisional application being CRR 1970 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

Case diary be returned to the learned advocate appearing for the State.

All concerned parties including the learned Trial Court shall act on the server copy of this order duly downloaded from the official website of this Court.
