In Re: An application under Section 401 and 482 of the Code of Criminal Procedure.

Sri Hare Krishna Das

Versus

The State of West Bengal Mr. Bidyut Kumar Ray, Ms. Manisha Sharma.

...for the State.

As none appears on behalf of the State, Mr. Bidyut Kumar Ray, learned advocate, is directed to appear and assist the Court. His appointment may be regularised by the concerned authorities.

The subject-matter of challenge in this revisional application relates to an order dated 6.03.2012 passed in connection with S.T. 25 of 2010 (S.C.152 of 2009). I find from the order under challenge that, on the said date, the examination-in-chief of the prosecution witness no.9 was completed and on the prayer of the accused, the cross-examination was deferred. The order further reflects that the documents relating to Savings Bank Account opening form and Pass Book receipt registrar were marked as exhibits 10 and 11 respectively. By the said order, the learned Sessions Court was pleased to fix 20.04.2012 as next date for further evidence. In view of the order so passed by the learned trial court, I

do not find any illegality in the same and, as such, no interference is called for.

Accordingly, CRR 1842 of 2012 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
