Learned counsels for the petitioners and the second opposite party submit that the dispute between the parties has been amicably settled. The parties seek disposal of the proceeding being G.R. case no. 2669 of 2014 pending before the learned Metropolitan Magistrate, 4th Court, Calcutta, presently redesignated as the learned Judicial Magistrate, 4th Court, Calcutta in terms of the memorandum of understanding executed by and between the parties on 19th January, 2024.

The statement of the de facto complainant/private opposite party appended to the report submitted by the State also corroborates the same.

In view of the above, this Court is inclined to hold that continuation of the proceeding shall only be a futile exercise. Accordingly, CRR 2021 of 2024 is allowed in terms of the memorandum of understanding executed by and between the parties on 19th January, 2024.

Proceedings of G.R. case no. 2669 of 2014 pending before the learned Metropolitan Magistrate, 4th Court, Calcutta, presently redesignated as the learned Judicial Magistrate, 4th Court, Calcutta be quashed.
