Learned advocate appearing for the petitioners submits that the private respondents entered into an agreement for a period of five years which is supposed to be terminated on 2026 and the Ratha Yatra Utsob Parichalan Committee without informing or terminating the agreement has allotted the fair to be organized by a different set of persons.

Police authorities have submitted a report. Report reflects that on receipt of the information furnished with Officer-in-Charge, Ramnagar Police Station conducted an enquiry from which he came to learn from the Committee that because of excess charges being made on the local villagers, the poor and needy villagers were deprived of installing any stall and the petitioner had excessively charged for amusement instruments and many first food

shops which compelled the Committee to allot to a different managing group.

Petitioner is aggrieved by such action of the Ratha Yatra Utsob Parichalan Committee and to that effect he had issued a demand justice notice.

However, having considered that the issue absolutely relates to breach of an agreement, police authorities have hardly any scope to interfere in such circumstances. The petitioner as such would be entitled to approach the jurisdictional Court for enforcing his rights under the agreement.

With the aforesaid observations WPA 12547 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to learned advocate appearing for the petitioners.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
