The petitioner before this court is the power of attorney holder in respect of a vehicle bearing registration no. NL01AE9477. The petitioner preferred for return of the seized vehicle before the learned ACJM, Jangipur which was turned down. The said order was challenged in Criminal Revision No. 70 of 2022 which was also dismissed by the learned Additional District and Sessions Judge, 2nd Fast Track Court, Jangipur, Murshidabad.

Record reflects that the present petitioner is also an accused in the case and the power of the attorney holder of the vehicle. Having regard to the same, I am not inclined to direct the vehicle to be returned to the petitioner namely, Mahammad Badiujjaman. However, a report has been submitted by the Inspector of Suti Police Station, Jangipur Police District which reflects that the owner of the vehicle happens to be the Tauqueer Ahmad. If the said Tauqueer Ahmad upon proper proof submits documents and prays for return of the seized vehicle before the

learned ACJM, Jangipur or any court in seisin of the Suti Police Station Case No. 571 of 2022, the learned court will return the vehicle on such terms and condition as it deems fit and proper. Report so submitted by the learned advocate for the State be kept with the record.

With the aforesaid observations, the revisional application being CRR 1972 of 2023 is disposed of.
