The plaintiff of the connected Title Suit No. 788 of 2021 pending before the 1st Court of learned Civil Judge, (Junior Division) at Barasat, District - 24 Parganas (North) is the petitioner of the present revisional application under Article 227 of the Constitution of India.

The grievance of the plaintiff is that though the time to file the written statement has already expired long back but the defendants are extending the said time only by praying adjournment. The prayer of the petitioner for expeditious disposal of the said suit is misconceived inasmuch as for redressal of his grievance, the plaintiff should resort to the provision of Order VIII Rule 1 of the Code of Civil Procedure.

C.O. 1771 of 2024 is disposed of with the above observations without any order as to costs.
