A representation has been forwarded by the present writ petitioner to the respondent authorities challenging grant of auto rickshaw permit for the route from Brace Bridge Railway Station to Moynagarh More via Sarkarpool, which, according to the writ petitioner falls under two different districts.

Mr. Khan appearing for the writ petitioner. He has mentioned about the Government Notification dated January 29, 2010, which, he says, has prohibited granting auto rickshaw permit in route and areas covering more than one district. The said representation is yet to be considered by the authorities.

The State respondents are represented.

In the facts and circumstances of the present case, this Court finds it proper to dispose of the present writ petition, by directing the respondent no.2/ the Regional Transport Authority, South 24-parganas, to consider the

petitioner's representation dated April 22, 2004 and dispose of it by dint of a reasoned order.

In doing so the concerned respondent shall afford opportunity of hearing to the petitioner and also the other persons as it may deem fit and proper. The concerned respondent no.2 shall dispose of the aforesaid representation of the writ petitioner within a period of six weeks from the date of communication of this order. The decision shall be communicated to the petitioner by dint of a written communication within a period of one week thereafter.

Since no affidavit-in-opposition has been called for in this case, all allegations made in this writ petition are deemed to have been denied by the concerned respondent.

The writ petition is disposed of.
