1. Heard Mrs. Kabari Roy, learned Counsel for the petitioner and Ms. Z. N. Khan, learned Counsel for the State.

2. This petition for anticipatory bail being CRM (A) 2130 of 2023 arises out of Krishnagar Women Police Station Case No. 24 of 2023 dated 06.04.2023 under Sections 323/ 341/ 354B/ 506/ 509/ 354A/ 34 IPC.

3. The petitioner is alleged to have developed unrequited love towards the victim. He is alleged to have offered a rose to the victim and when the victim declined, he is alleged to have touched her private parts and threatened her to marry forcefully.

4. Considered the materials placed by learned Counsel for the parties including the statement of the witnesses and the victim.

5. The petitioner is stated to be a man aged about 28 years old

and the victim is stated to be a girl aged about 17 years old.

6. There is a case and counter case between the parties.

7. It is submitted by learned Counsel for the petitioner that the petitioner having been assaulted by the informant party had instituted a case against the informant and others being Krishnagar, Kotwali P.S. case No. 201 of 2023 dated 06.03.2023 under Sections 341/325/307/506 IPC. The present case is stated to be a counter-blast by the informant party.

8. Admittedly, there is no past criminal antecedent against the petitioner.

Regard being had to such facts and submissions, factum of permanent residence of the petitioner, and substantial progress in the investigation, it is directed that the petitioner shall be released on bail by the Arresting Officer in the event of his arrest on such terms and conditions as deemed just and proper in the facts and circumstances of the case including the conditions that i) petitioner shall appear before the I.O. once in alternative day till the submission of F.F.; i.a) on his appearance before the I.O. he shall account for his conduct before the I.O. in the previous day till his time of appearance; ii) he shall not threaten, induce of coerce any of the witnesses including the victim in this case in any manner whatsoever during the currency of this order; iii) he shall not visit any place within periphery of 200 meters from the house

of the victim girl.

10. Accordingly, the prayer for the anticipatory bail is allowed.
