The opposite party/wife is present before the Court. She is represented by the learned advocate Mr. Ali Ahsan Alamgir who has filed fresh vakalatnama in the Court. Let the same be kept on record.
The instant revisional application has been filed against an order dated 10th June, 2011 passed by the learned Sessions Judge, Bankura in Criminal Revision No. 76 of 2010 thereby affirming the order dated 12th August 2010 passed by the learned Judicial Magistrate, 6th Court Bankura directing the petitioner to pay a sum of Rs. 1200/- per month as maintenance to his wife.
Perused the contentions of the petition as well as the impugned order the marriage between the parties is not disputed. The allegation raised by the petitioner pertains to a proceeding distinct from the instant proceeding. The maintenance of Rs. 1200/- per month to be paid to the opposite party was justified and this court is not inclined to interfere with the impugned order.
Accordingly, the instant revisional application and connection application being 1/2011 (Old No. CRAN 1970/2011) are dismissed.
The personal appearance of the opposite party is noted and dispensed with.
Copy of the order be sent to the Department as well as trial court for due compliance.
