The petitioner is aggrieved by non-disposal of the certificate proceeding arising out of order dated 3rd June, 2022 passed by the controlling authority under Section 7(3A) of the Payment of Gratuity Act, 1972.

Counsel for the respondents submits that an appeal has been preferred against the said certificate on 6th October, 2023 by post.

If the appeal has, in fact, been registered by the appellate authority, it is ordered that the same is disposed of upon due notice to all parties in terms of the Rules,

within a period of one month from the date of communication of a copy of this order.

Let a copy of the appeal be given to the counsel for the petitioner.

If the appeal has not been registered, the certificate officer shall dispose of the proceedings, within a period of one month from the date of communication of a copy of this order.

With the aforesaid directions, the instant writ petition shall stand disposed of.

7.

There shall be no order as to costs.

8.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
