The instant revisional application has been preferred against judgment and order dated 23.02.2011 passed by the learned Judicial Magistrate, 2nd Court, Malda in Case N 289(M) of 2005/T.R. No. 424 of 2006 under Section 125 of the Code of Criminal Procedure.
By virtue of the impugned order the petitioner was directed to pay a sum of Rs. 2500/- wife as monthly maintenance (Rs. 1500/- for the wife and Rs. 1000 for the minor son) in the year 2011. The minor son possible must have been major on this date. The marriage between the parties has not disputed. Vide order dated 12.07.2011 had directed the petitioner to pay a consolidated amount of Rs. 1800/- per month and the impugned order was stayed for a period of eight weeks or until further orders whichever was earlier. The impugned order does not suffer from any illegality or impropriety and as such this court is not inclined to interfere with the same.
Accordingly, the instant revisional application is dismissed. Copy of the order be sent to the Department as well as learned Trial Court for due compliance.
