Mr. Pantu Deb Roy Mr. Pannalal Bandopadhyay .....For the State Mr. Ashim Routh .....For the Respondent This is a writ petition wherein the petitioner is aggrieved by the respondents/authorities in not transferring the ownership of the vehicle purchased by the petitioner by way of an auction from the Corporation Bank.

Mr. Pantu Deb Roy, learned counsel, appearing on behalf of the State submits that Form 36 is required to be filed by the Corporation Bank in terms of sub-Section (5) of Section 51 of the Motor Vehicles Act, 1988.

Mr.

Bhaskar Nandi, learned counsel, appearing on behalf of the Corporation Bank submits that the bank is willing to cooperate in all respects and in the event, the petitioner approaches the bank with the relevant form, it shall complete the formalities at the earliest.

In light of the above submissions, the

petitioner is directed to approach the Corporation Bank within a week with the relevant form and the Bank is directed to immediately complete all the formalities.

The petitioner is thereafter directed to file all the relevant papers to the relevant authority and the authority concerned is directed to act expeditiously in accordance with law within a period of two weeks from date of submission of the relevant papers. Accordingly the writ petition is disposed of. There will be no order as to costs.
