Bose ...For the Respondent Nos. 2 & 3 The grievance of the petitioners is directed against non-consideration of their representation dated 4th November, 2020 and 7th October, 2021. It is submitted on behalf of the petitioners that the petitioners are entitled to fixation of pay as per ROPA, 2020.

On behalf of the West Bengal Power Development Corporation, it is submitted that the petitioners are being paid on the basis of WBPDCL Revision and Pay and Allowance Rules, 2020 (ROPA 2020) and there is no question of the petitioners not availing benefits thereunder.

The petitioner has also filed a representation as far back as on 4th November, 2020 as

also a legal notice as on 7th October, 2021 which remains unanswered till date.

In view of the submissions made on the of the parties, the respondent No. 3 being the Director of Human Resources, West Bengal Power Development Corporation Limited is directed to consider and dispose of the representations of the petitioners dated 7th October, 2021 and 4th November, 2020 respectively within a period of eight weeks from the date of communication of the passing of this order.

With the aforesaid directions, nothing survives in the writ petition. WPA 12752 of 2023 stands disposed of accordingly.

It is made clear that there has been no adjudication on the merits of the case and the respondent No. 3 is to act without being influenced by any observation made in this order and in accordance with law. The respondent no. 3 is also at liberty to authorize any other officer competent to consider the aforesaid representations.
