And In Re : Gobinda Sen ........ petitioner Ms. Jeenia Rudra ...... for the petitioner Mr. Sudip Ghosh Mr. Bitasok Banerjee ...... for the State The petitioner is in custody for 2 years.

It is submitted there is slow progress in the trial of the case. Learned lawyer for the State opposes the prayer for bail. Report is placed on record. It appears from the report petitioner initially had a Bangladeshi passport. Subsequently, he fraudulently procured an Indian passport.

In view of the aforesaid fact and the prima facie materials showing fraudulent procurement of Indian passport by the petitioner, we are of the opinion that this is not a fit case where the petitioner may be enlarged on bail.

Accordingly, the prayer for bail is rejected. Trial be expedited.
