Present petition has been filed for transfer of proceeding being Miscellaneous (Act - VIII), Case No. 14 of 2024 pending before Learned Principal Judge, Family Court at Bankura to the Learned Principal Judge, Family Court at Paschim Medinipur.

Learned Counsel submits that respondent/husband filed an application has been filed Guardians and Wards Act, 1890. Learned counsel further submits petition itself is maintainable as the child is ordinarily resident of Paschim Medinipur. Learned counsel seeks permission to withdraw the present petition with liberty to take this objection before the learned Principal Judge, Family Court at Bankura.

Liberty granted.

Petition is disposed of.

However, this Court has not gone into the merits of the case and no expression made herein shall tantamount to be an expression merits of the case.

It is further directed that till the decision of the territorial jurisdiction the Learned Family Court shall not insist on the personal presence of the petitioner/wife.
