Report submitted by the learned advocate appearing for the State be kept with the record. A copy of the report be handed over to the learned advocates appearing for the petitioner and respondent no.4.

The petitioner approached the police authorities with a specific prayer in respect of interference with her property against the private respondent no.4. To that effect, police authorities called for a report from the Officer-in-Charge, Town Survey Unit, Howrah, Government of West Bengal. The name of the petitioner is not appearing in the records of the office of Officer-in-Charge, Town Survey Unit, Howrah. However, the petitioner now claims that she is being threatened for filing such complaint and for the purposes of withdrawal of such complaint.

In case the petitioner receives any threat from any private individual, the police authorities would ensure that no harm is created upon her. However,

the same do not create any right, title and interest in respect of the property claimed in the writ petition. It would be the absolute domain of the authorities concerned who are in possession of the records in respect of right, title and interest of the property.

The police report has also reflected that the portion of the land which has been shown by the petitioner has nothing to do with the private respondent concerned and the private respondent has shown a different land for which ownership has been claimed by him.

With the aforesaid observations, the writ petition being WPA 13766 of 2024 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
