The petitioner is aggrieved by the fact that although the case was initiated in the year 2021 under the provisions of Section 138 of N. I. Act, but the accused persons are evading the process of law.

Learned advocate for the petitioner is aggrieved by the fact that his application under Section 143A of the N. I. Act for interim relief is still pending and is yet to be disposed of. The next date, according to the learned advocate for the petitioner, is fixed on 20th September, 2023. The learned Judicial Magistrate, 5th Court, Alipore is directed to dispose of the said application under Section 143A of the N. I. Act on the next date so fixed or within a fortnight thereafter. Learned Magistrate would thereafter adhere to the provisions of the N. I. Act regarding conclusion of the trial of such case and fix dates at regular intervals preferably in every two months so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary

adjournments should be granted to either of the parties. With the aforesaid observations, the present revisional application being CRR 1974 of 2023 is disposed of. All Pending applications, if any, are disposed of accordingly. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court.
