Petitioner claims that he has paid Rs. 1,00,000/- (one lakh) to Shree Ram Krishna Institute of Medical Sciences and Sanaka Hospitals for his admission in the M.B.B.S. course for the year 2021-22. Though his admission was refused by the college, the said one lakh rupees received from the petitioner had not been returned.
It has been submitted by Mr. Mukteswar Maiti, learned advocate for the petitioner that a letter dated April 29, 2022 was written by the petitioner to the Principal of the said college for refund of the money but the college refused to refund the same.
Learned advocate appearing for the college submits that the letter dated April 29, 2022, was replied to the petitioner by a letter dated May 17, 2022. He has made over a copy of this letter to Mr. Maiti.
He denies the allegations made by the petitioner and submits that the college has received no money from the petitioner.
In view of the disputed facts involved in this case, there is no scope to entertain this writ petition. However, petitioner will be at liberty to lodge complaint before the appropriate authority or take any action in accordance with law for redressal of his grievance.
WPA 12229 of 2022 is disposed of.
Let urgent certified copies of this order, if applied for, be given to the parties upon compliance with all the necessary formalities.
