In view of the development that has cropped up in a similar writ petition being WPA 12783 of 2023 (Tapan Kumar Chakraborty -vs- State of West Bengal & ors.), the Court is not convinced to pass the order as was passed on 19th June, 2023.

In view of the above, the order dated 19th June, 2023 stands recalled.

Learned advocate appearing for the State respondents is directed to take specific instruction from the authorities as to whether the petitioner at all filed the present writ petition or not.
