The defendant no.1 in a suit for partition is the petitioner in the present application under Article 227 of the Constitution.

The petitioner prays for a direction upon the learned Trial Judge for expeditious disposal of the application for injunction filed by the plaintiff in the said suit being Title Suit No. 138 of 2021.

It appears from record that the said suit was filed only on February 17, 2021 and an ad interim order of injunction was passed on the said date. Therefore, it is very pre-mature to direct the learned Trial Judge to dispose of the said application within a specific period of time.

However, the 3rd Court of the learned Civil Judge (Senior Division) at Barasat, District 24Parganas (North) is requested to expedite the disposal of the said application, if it is otherwise ready for such disposal.

C.O. 1482 of 2021 is thus disposed of without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
