The defendants in a suit for declaration are the petitioners in the present application under Article 227 of the Constitution.

The petitioners are praying for a direction upon the 2nd Court of the learned Civil Judge (Senior Division) at Howrah for expeditious disposal of the application for injunction filed in connection with Title Suit No. 328 of 2021.

It appears from record that the said suit was filed only on June 19, 2021. Therefore, at this stage, direction as prayed for, is too pre-mature.

However, the learned Trial Judge is requested to make all endeavour to dispose of the said application for injunction expeditiously if it is otherwise ready for such disposal.

C.O. 1483 of 2021 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
