The petitioner is directed to serve a copy of this revisional application upon Mr. Imran Ali, learned advocate who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.
Mr. Basu, learned senior advocate appearing for the petitioner submits that the petitioner intends to surrender before the learned jurisdictional court being the learned Additional Chief Judicial Magistrate, Chanchal, Malda. Mr. Ali, learned advocate for the State opposes such contention.
However, having regard to the fact that the petitioner intends and undertakes to surrender, I direct that in case, the petitioner surrenders by 30.06.2023 before the learned Additional Chief Judicial Magistrate, Chanchal, Malda and prays for bail having regard to the time period which has elapsed in the meantime, the learned trial court will consider his application for bail in accordance with law keeping in
mind whether his custodial detention is warranted or not since the charge-sheet has already been submitted. In case, the petitioner does not surrender by 30.06.2023, the learned trial court would revive the warrant of arrest on 03.07.2023. Till 30.06.2023, execution of the warrant of arrest be kept in abeyance.
With the aforesaid observations, the revisional application being CRR 1978 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.
All concerned parties including the learned Trial Court shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
