1. Affidavit of service filed in Court today is taken on record.

2. Mr. Bera, learned advocate representing the petitioner by placing before this Court a communication issued by the petitioner, addressed to him, submits that since during the pendency of the aforesaid writ petition, the petitioner has already got the goods released upon payment of penalty imposed by the proper officer in terms of Section 129 of the Central/West Bengal Goods and Services Tax Act, 2017, the present writ petition has become infructuous. As such he prays for leave to withdraw the same.

3. In view thereof, let the writ petition be dismissed as withdrawn.

4. Let the communication, as handed over to the Court by Mr. Bera, be taken on record.
