Jadunandan Mondal v. Kaushik Bhattacharya & ORS
08.07.2022 Item No. 02 Court No.32 Avijit Mitra CPAN No. 651 of 2019 in WPA No. 3874 of 2019 Jadunandan Mondal - Versus - Sri Kaushik Bhattacharya & Ors.
Ms. Papiya Chattopadhyay For the petitioner Ms. Chattopadhyay, learned advocate appearing for the petitioner submits that during pendency of the present contempt application, a part of the order has been complied with by the Pradhan of the concerned gram panchayat and the petitioner's land has been demarcated. But thereafter the respondents have not taken the necessary follow up steps, as directed by this Court. Let the supplementary affidavit, filed by the petitioner, annexing the order passed by the concerned Pradhan on 22nd February, 2021, be kept on record.
It appears that pursuant to the order passed by this Court, the petitioner's representation was considered by the concerned Pradhan. A government Amin was engaged and the land belonging to the petitioner was demarcated.
It thus appears that there had been no deliberate or intentional violation of the order passed by this Court.
In view thereof, the contempt application being CPAN 651 of 2019, is dismissed.
Needless to observe, dismissal of the contempt application shall not prevent the petitioner from taking necessary steps against the private respondents before the appropriate forum.
All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
