Ms. Khan, learned advocate appearing for the State submits that the applicant has been released on 18th April, 2022. This court had acquitted the applicant vide order dated 07.02.2022.

The court had further directed as follows:

"Appellant Bistu Das shall be forthwith released from custody, if not wanted in any other case, upon executing a bond to the satisfaction of the trial court for a period of six months in terms of Section 437A of the Code of Criminal Procedure."

It appears that the order was duly communicated to the trial court. But the appellant was not released. From the averments in the application being CRAN 3 of 2022 as well as the report of Superintendent Krishnagar, District Correctional Home, Nadia it appears that the trial court had not issued a

release order which apparently delayed the release of the applicant.

Under such circumstances, we call upon the trial Judge, that is, Additional District & Sessions Judge, Ranaghat, Nadia to submit report why there was delay in issuing the release order in the instant case.

Registrar (Judicial) shall communicate this order to the trial Judge for due compliance and report be filed on the adjourned date.

The matter is adjourned for one week.
