According to the petitioner, although the suit was filed in 2018, issues were framed only on January 24, 2023. The petitioners pray for expeditious disposal of the suit on the ground that delay in disposal of the suit was causing irreparable loss and injury to the petitioners.
The prayer of the petitioners for expeditious disposal is innocuous.
This court is of the view that prior notice need not be served upon the opposite party and the order for expeditious disposal shall only enure to the benefit to all the parties.
Accordingly, the revisional application is disposed of with a direction upon the learned Civil Judge (Junior Division), 2nd Court, Burdwan to dispose of the title suit within a mandatory period of one year from the date of communication of this
order. No unnecessary adjournments shall be allowed to any of parties.
A copy of this revisional application along with sever copy of this order be served upon the opposite party within a period of a week from date.
All the parties and the learned court below shall act on the basis of the server copy of this order. (Shampa Sarkar, J.)
