Learned advocate appearing for the petitioner submits that the petitioner happens to be the owner of the property and he is being harassed, abused and being attempted to be dispossessed. Learned advocate appearing for the private respondent no.6 disputes and denies the contentions made in the writ petition.

State has submitted a report which reflects that number of cases on issues of apprehended danger and nuisance have been drawn up by the police authorities under the relevant provisions of law.

A representation was sent by the petitioner on 19.05.2023. Having considered the period which has lapsed and the fact that threat and harassment

is being handled by the police authorities by keeping a vigil and tranquility in the area, I direct that in case there are further disturbances, the police authorities would take appropriate steps. If the petitioner is aggrieved, the petitioner would approach the jurisdictional court by way of invoking the provisions of Section 175(3) of BNSS or under Section 223 of BNSS.

With the aforesaid observations, the writ petition being WPA 12820 of 2023 is disposed of. There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
