Sk. Raidul Islam v. State Of West Bengal And ORS.
D/L 78 30.06.2025 ct.no.35 Kausik W.P.A. 12706 of 2025 Sk. Raidul Islam
Versus
State of West Bengal & Ors.
Mr. S. Kr. Ray Mr. Baidurya Ghosal ...for the petitioner.
Mr. Swapan Banerjee, Ld. AGP Mr. Diptendu Narayan Banerjee Mr. Soumen Chatterjee ...for the State.
Petitioner is aggrieved by the fact that the private respondents had been forcibly detaining the vehicle of the petitioner which is having registration no. WB 33 F 3096 and which has a registered permit for plying from Moyna to Bishnupur. According to the petitioner, the vehicle has been forcibly restrained at Bishnupur Bus Stand.
State has submitted a report. Report reflects that on 18.06.2025 the petitioner got back the vehicle/Bus with his instruments from parking space of Bishnupur Bus Stand and a declaration of Suresh Maity has been taken.
The dispute and difference as is reflected from the police reports relates to a vehicle being WB 33F 2282. There are some financial disputes
between the petitioner and the private respondent no. 7.
Be that as it may, police authorities would ensure that the plying of the vehicle pursuant to the permit being granted by the appropriate authority in no manner should be stalled. However, this would not prevent the respondent no. 7 to take steps in accordance with law, if there are other disputes. With the aforesaid observations WPA 12706 of 2025 is disposed of.
Report so submitted be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
