The learned Advocate for the petitioner is present. Mr. Arjun Roy Mukherjee, represents the State respondents.

Since Mr. Roy Mukherjee is busy in another Court, Mr. J. Medhi, learned Advocate who has submitted that he will be able to represent the respondents is present.

At this stage, the learned Advocate for the petitioner submits that in the instant writ petition, the petitioner has challenged grant of licence in favour of the private respondent. However, the documents annexed by the petitioner in support of his case, may not establish the contention of the petitioner. He has prayed liberty to file a fresh writ petition with the relevant documents.

The instant writ petition is, therefore, dismissed with liberty to the petitioner to file a fresh writ petition.

It is directed that the petitioner shall serve a copy of the writ petition to Mr. Arjun Roy Mukherjee, learned Advocate for the State.

The learned Government Pleader is requested to regularize the appointment of Mr. Arjun Roy Mukherjee in the writ petitioner that will be filed by the petitioner so that the matter can be disposed of at the earliest. The petitioner is also directed to serve notice upon respondent No.9, the private respondent. (Bibek Chaudhuri, J.)
